Body Studio Bali — operated by PT New Beginnings Retreat

This English text is provided for the convenience of international clients. The Bahasa Indonesia version of these Terms of Use is the legally controlling version in accordance with Law of the Republic of Indonesia No. 24 of 2009 (UU 24/2009). In case of any inconsistency between the two versions, the Bahasa Indonesia version prevails.

1. Introduction & Parties

These Terms of Use (“Terms“) govern your access to and use of the website bodystudiobali.com and all beauty, aesthetic, and SPA services offered at the premises of Body Studio Bali.

The operator of Body Studio Bali and of bodystudiobali.com is:

In these Terms, “we“, “us“, “our“, or “Body Studio Bali” refers to PT New Beginnings Retreat. “You“, “your“, or “Client” refers to any person who books, purchases, receives, or uses any of our services, or who accesses our website.

By booking a service, paying for a service, attending an appointment, using a gift voucher or package, or otherwise using our services or website, you confirm that you have read, understood, and agreed to be bound by these Terms.

2. Definitions

• Beauty Service / Aesthetic Service — any cosmetic, beauty, or SPA service offered by Body Studio Bali, including manual treatments, machine-assisted aesthetic treatments, and combinations of the foregoing.
• Perlakuan — used in these Terms as a synonym for Beauty Service / Aesthetic Service. Use of the word “treatment” does not imply medical treatment.
• Combo / Package — a pre-defined combination of Beauty Services delivered as one unit (e.g. Express Slimming Package, Combo 10 Slimming, Combo 20 Slimming, Combo 10 Face, Holistic Wellness Combo).
• Sidang — a single appointment delivering one or more Beauty Services.
• Practitioner / Beauty Therapist / SPA Professional — a member of our staff licensed to perform Beauty Services. Our staff are beauty professionals; they are not doctors, medical practitioners, nurses, or healthcare providers.
• Pemesanan — any reservation of a Session, made online, via WhatsApp, by telephone, or in person.
• Premises — the physical Body Studio Bali location at Uluwatu St No.184, Ungasan, Bali.
• Intake & Consent Form — the written health-disclosure and informed-consent form a Client must complete and sign at first visit and re-confirm before any new service type. See Section 6.

3. Nature of Our Services — NOT Medical

This clause is fundamental to your understanding of these Terms.

All services offered by Body Studio Bali are beauty, aesthetic, and SPA services performed under the Indonesian SPA / Salon KBLI license. Our services are not:

• medical, therapeutic, clinical, or diagnostic services;
• a substitute for medical advice, medical examination, medical diagnosis, or medical treatment;
• intended to treat, diagnose, prevent, cure, or alleviate any disease, injury, or medical condition.

Our practitioners are licensed beauty therapists / SPA professionals, not medical staff. They do not provide medical advice, medical opinions, medical assessments, or prescriptions, and nothing said or written by a practitioner should be relied on as such.

Any wording on our website or marketing materials that describes “results”, “support”, “stimulation”, “detoxification”, “circulation”, “lifting”, “contouring”, “slimming”, or similar effects describes cosmetic and aesthetic effects only. Such wording is not a medical claim and must not be interpreted as a promise of any health benefit, medical outcome, or clinical effect.

If you require medical care, advice, or diagnosis, you must consult a qualified medical doctor. Body Studio Bali is not equipped to and will not provide such care.

4. Scope & Acceptance

These Terms apply to:

• every Booking, whether made online via bodystudiobali.com, via WhatsApp, by telephone, or in person;
• every gift voucher purchase or redemption;
• every Session of every Combo or Package;
• every visit to the Premises; and
• every use of the bodystudiobali.com website.

Acceptance of these Terms is layered:

• Layer 1 — Booking acceptance. When you book online, you must tick the box confirming agreement with these Terms (including the Health Disclosure & Doctor-Consultation Duty in Section 6) before your booking can be completed. When you book via WhatsApp, telephone, or in person, you accept these Terms by confirming your booking and/or by attending your appointment.
• Layer 2 — Intake & Consent Form. At your first visit, and at the start of any new service type or new Combo/Package, you must complete and sign our Health Intake & Informed Consent Form. This form references these Terms and these Terms reference the form. Completion of the form is a precondition for receiving any service.

If you do not agree to these Terms, you must not book or attend any service.

5. Bookings, Payment, Punctuality

• Booking confirmation. A Booking is only confirmed once we have confirmed it in writing (email, WhatsApp, or our online system). Until then, the requested time slot is not held.
• Deposit / payment. Some services or packages may require a deposit or full pre-payment. Any such requirement will be communicated to you at the time of Booking.
• Punctuality. Please arrive at least 10 minutes before your Session. If you arrive late, your Session may be shortened to fit the original end time, and the full price remains payable. We may refuse a service if you arrive too late for it to be safely or properly performed.
• Refunds, cancellations, no-shows, and gift voucher / package validity are governed by our separate Refund and Cancellation Policy (to be published). These Terms do not by themselves grant or remove any cancellation, refund, or voucher-validity rights — those are addressed in the separate policy.

6. Health Disclosure & Doctor-Consultation Duty

This is the most important section of these Terms. Please read it carefully.

6.1 Pre-Booking Doctor Consultation — BEFORE booking

If you have any health condition, are pregnant or breastfeeding, take prescription medication, have implants or medical devices, or are recovering from surgery or illness, you MUST consult your personal doctor BEFORE booking any service at Body Studio Bali.

You must consult your personal doctor before booking if any of the following applies to you, including but not limited to:

• cardiovascular disease (heart conditions, high or low blood pressure, recent heart events);
• past or current oncological condition (cancer, current treatment, history of cancer);
• pregnancy at any stage or breastfeeding;
• any surgery or significant medical procedure within the last 6 months;
• neurological conditions (epilepsy, multiple sclerosis, neuropathy, recent stroke, etc.);
• blood-clotting disorders, deep vein thrombosis, or use of anticoagulant or blood-thinning medication;
• autoimmune disease;
• skin disease, severe acne, open wounds, infections, or rashes in any potential treatment area;
• implants and medical devices: pacemaker, defibrillator, intrauterine device (IUD), metal implants, silicone or other body implants, dermal fillers, recent injectables;
• photosensitivity or use of photosensitizing medication;
• diagnosed or suspected hernia in any potential treatment area;
• severe varicose veins, fragile capillaries, or bleeding disorders;
• kidney or liver disease;
• any other serious or chronic health condition.

If you are unsure whether your situation requires medical consultation, you must consult your doctor first. When in doubt, do not book until you have your doctor’s clearance.

It is your sole responsibility to seek and obtain this medical advice. Body Studio Bali cannot and will not provide it.

6.2 Pre-Procedure Disclosure — BEFORE the first procedure of every service or combo

Before the first session of every beauty service or combo, you MUST disclose all relevant health information to our beauty therapist. This duty repeats for every distinct service type, even within the same visit, and again for any new combo, package, or service category you book later.

In practice this means:

• At your first visit, you complete and sign our Health Intake & Informed Consent Form.
• Before the first session of any new service type (for example: your first cryolipolysis session, your first cavitation session, your first lymphatic drainage massage, your first body wrap, your first Combo 10, etc.), you verbally re-confirm your health status with the practitioner and update the Intake form if anything has changed.
• This disclosure duty applies per service type — not per visit and not per combo. If a single visit includes more than one service type, you must disclose for each. If you previously disclosed for service A, that disclosure does not cover service B, and a new disclosure is required for service B.
• You must inform us of any change in your health status (new diagnosis, new medication, new pregnancy, new injury, recent surgery, etc.) before any subsequent session, even if it is the same service type as before.

You warrant that all information you provide is truthful, accurate, complete, and up-to-date. Withholding, omitting, or misstating health information is a material breach of these Terms.

6.3 Right to Refuse, Postpone, or Modify a Service

Our practitioners may, at their sole professional discretion:

• refuse to perform a service;
• postpone a service to a later date;
• modify a service (for example, reduce intensity, change technique, skip a target area, or substitute a different service);

based on the information you have disclosed, on visible signs (skin condition, recent injury, intoxication, fever, etc.), or on professional judgement. No refund obligation arises from a refusal, postponement, or modification that results from incomplete, false, or withheld disclosure on your part.

6.4 Services Are Aesthetic, Not Medical

For the avoidance of doubt, our practitioners are not qualified to assess whether you are medically fit for any service, and any acceptance of you as a Client by Body Studio Bali does not constitute medical clearance. Medical clearance is your doctor’s responsibility, not ours. See Section 3.

7. Per-Category Contraindication Schedule

The list below is non-exhaustive and is provided for your information. It does not replace the duty in Section 6 to consult your personal doctor before booking and to disclose your health information before each service type.

Absolute contraindications mean: the service must not be performed. Relative contraindications mean: the service may only be performed with prior written clearance from your doctor.

If any of these contraindications applies to you, or if you are unsure, you must consult your doctor before booking (Section 6.1) and disclose to our practitioner before the service (Section 6.2).

8. Conduct on the Premises

To protect all our Clients and staff, we ask you to:

• arrive in good personal hygiene;
• silence mobile phones during Sessions;
• not attend the Premises under the influence of alcohol or non-prescribed drugs;
• not behave in a manner that is harassing, threatening, abusive, or sexually inappropriate towards any staff member or other Client.

We reserve the right to refuse service, terminate a Session, and require a person to leave the Premises for breach of this Section. No refund is owed in such a case.

9. Children & Minors

• Clients under the age of 18 are considered minors.
• A minor must be accompanied by a parent or legal guardian at all times on the Premises, and the parent or legal guardian must provide written consent and complete the Intake & Consent Form on the minor’s behalf.
• Machine-assisted aesthetic services (cryolipolysis, cavitation, RF, electrostimulation, laser, LPG, Endospheres, etc.) are not available to clients under 18.
• Beauty Services that are appropriate for minors (for example basic manicure, pedicure, brow shaping) may be provided at our discretion with parental/guardian consent.

10. Photography, Before/After & Marketing Consent

• Photography or recording on the Premises by Clients is not permitted without our written consent.
• We may take “before / after” photographs of treatment areas for clinical and marketing purposes only with your prior written, opt-in consent, recorded on the Intake & Consent Form or on a separate consent form.
• You may withdraw your consent at any time by writing to info@bodystudiobali.com. Withdrawal applies prospectively — material already published before your withdrawal will be removed where reasonably practicable.

11. Intellectual Property

All content on bodystudiobali.com (text, images, photographs, videos, layout, design, brand names, logos, trade names, service names, treatment-protocol descriptions) is owned by PT New Beginnings Retreat or licensed to us, and is protected by Indonesian and international intellectual-property law.

You may view the website for personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, or commercially exploit any part of the website without our prior written consent.

12. Limitation of Liability & Outcome Disclaimer

12.1 Outcome disclaimer

Results of Beauty Services vary substantially from person to person. They depend on, among other things, your individual physiology, age, skin type, body composition, lifestyle, hydration, nutrition, hormonal status, consistency of attendance, post-service compliance, and many other factors outside our control.

Body Studio Bali does not guarantee any specific outcome (including, without limitation, weight loss, centimetre reduction, body contouring, skin appearance, skin lifting, cellulite reduction, fat reduction, muscle tone, or facial contour). Any descriptive language on our website, in our marketing materials, in our pricelist, or in conversation with our practitioners — including phrases such as “up to X cm”, “supports collagen stimulation”, “supports detoxification”, “smooths cellulite”, or similar — describes typical aesthetic effects under ideal conditions. Such language is not a guarantee, warranty, or promise of any specific outcome for you.

12.2 Liability cap

To the maximum extent permitted by Indonesian law, and without prejudice to any non-waivable rights you may have under Law of the Republic of Indonesia No. 8 of 1999 on Consumer Protection (UU 8/1999):

• our aggregate liability towards you arising out of or in connection with any Beauty Service, Booking, or use of our website is limited to the price you actually paid for the relevant Service or Session;
• we are not liable for any indirect, consequential, incidental, or special damages, including without limitation loss of earnings, loss of opportunity, loss of profits, emotional-distress damages, or damages arising from any outcome that fails to meet your personal expectations;
• we are not liable for harm, injury, adverse reaction, or unsatisfactory result arising from health information that you withheld, omitted, misstated, or failed to update under Section 6.

This limitation does not apply to liability for gross negligence or willful misconduct by us, which under Indonesian law cannot be excluded. The remainder of this Section shall remain in full force even if any sub-clause is found unenforceable.

13. Indemnification

You agree to indemnify, defend, and hold harmless PT New Beginnings Retreat and its staff against any claim, loss, liability, cost, or expense (including reasonable legal fees) arising from or connected with:

• your breach of these Terms;
• your withholding, omission, or misstatement of health information under Section 6;
• your conduct on the Premises in breach of Section 8; or
• your use of the website in breach of Section 11.

14. Privacy

Your personal data (including the health information you disclose under Section 6) is collected, stored, and processed solely for the purpose of providing services to you, contacting you about appointments, and fulfilling our legal and regulatory obligations.

A separate Privacy Policy governing data collection, retention, and your rights as a data subject will be published. Until that policy is published, the principles set out in this Section apply: we will not sell your personal data, we will limit access to authorised staff, and we will retain it only for as long as reasonably necessary.

15. Force Majeure

We are not liable for any failure or delay in performing our obligations (including delivering or rescheduling Sessions) that results from causes beyond our reasonable control, including without limitation: natural disasters, earthquakes, floods, fires, severe weather, epidemics or pandemics, government orders or restrictions, civil unrest, power outages, internet or telecommunications outages, and acts of third parties.

16. Changes to These Terms

We may update these Terms from time to time. The current version is the version published at bodystudiobali.com/terms-of-use/.

For non-material changes (typographical corrections, formatting), the updated version takes effect on publication. For material changes (changes to liability, health-disclosure rules, scope, payment, or governing law), we will notify you at your next Booking confirmation, and the updated version will apply to that and to any subsequent Booking.

17. Governing Law & Dispute Resolution

• These Terms and any dispute, claim, or controversy arising out of or in connection with them are governed by the laws of the Republic of Indonesia.
• The parties shall first attempt to resolve any dispute by good-faith negotiation. If the dispute is not resolved within 30 (thirty) days of written notice from one party to the other, either party may bring the matter before the competent Pengadilan Negeri Denpasar (District Court of Denpasar), without prejudice to any non-waivable consumer rights to seek redress through Indonesian consumer-protection forums (Badan Penyelesaian Sengketa Konsumen, BPSK) or other statutory bodies.

(The user / counsel may opt to substitute mandatory mediation or BANI arbitration; this clause is to be confirmed by Indonesian counsel before publication.)

18. Severability, Entire Agreement, Language Precedence

• Severability. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions remain in full force and effect.
• Entire Agreement. Together with the Health Intake & Informed Consent Form and (once published) the Refund and Cancellation Policy and Privacy Policy, these Terms constitute the entire agreement between you and PT New Beginnings Retreat in relation to your use of our services and our website. They supersede any prior oral or written representations.
• Language precedence. These Terms are issued in English and in Bahasa Indonesia. The Bahasa Indonesia version is the legally controlling version in accordance with Law of the Republic of Indonesia No. 24 of 2009 (UU 24/2009). The English version is provided for the convenience of international Clients only.
